§ 305 Abs. 1 BGB

General terms of sale are standard terms of contract set by one party (user) to another party upon conclusion of a contract. This standard form contract does not allow for negotiation. And it is irrelevant if the clauses are a special part of the contract, their complexity, of which typeface they are or the form of the contract itself. General terms of sale are not given if there are special conditions set between the two parties.
